Terms and Conditions
These General Terms of Use (hereinafter “Terms”) govern the contractual relationship between Showbiz Movies Srl and the User who registers on the showbizinc.it Platform as a profile (model, hostess, performer or similar figure).

1. Definitions
For the purposes of these Terms, the following definitions apply:
- Owner / Showbiz: Showbiz Movies Srl, registered office at Via Ugo Lenzi 12, 40122 Bologna (BO), Italy, VAT IT03382321200, email [email protected].
- Platform / Site: the website showbizinc.it and its integrated communication channels (including the WhatsApp channel).
- User: the adult natural person who registers on the Platform to create a professional profile in the fashion, entertainment, hostess and related sectors.
- Profile: the set of data, photographs, videos and information uploaded by the User to the Platform.
- Client: a company or private individual that uses the Platform to search for profiles for their professional needs.
- Casting: a work opportunity published on the Platform by a Client.
- Access Credential / WhatsApp Access: the WhatsApp phone number registered by the User at sign-up, which is the sole authentication method for the Platform and through which the User can interact with their profile and personal data.
- Agreement: these General Terms of Use, together with the Privacy Policy and any updates published on the Site.
2. Subject Matter — No Employment Relationship
These Terms govern exclusively the registration, profile management and participation in the activities of the Platform by Users registered as profiles.
Acceptance of these Terms does not constitute, nor is it in any way comparable to, a contract of employment (whether dependent or self-employed), agency agreement, coordinated and continuous collaboration (co.co.co.), or any other form of employment or quasi-employment relationship between the User and Showbiz. Merely registering on the Platform and creating a profile does not give rise to any entitlement on the part of the User to fees, reimbursements, allowances, social security, insurance or any other benefit from Showbiz.
Showbiz enters into specific contractual arrangements — entirely separate from and subsequent to these Terms — exclusively and only if the User is selected for a specific assignment following a casting call, and only where the nature of the assignment requires it under applicable law. This is entirely separate from and independent of acceptance of these Terms, and does not constitute an implied commitment of any kind by Showbiz.
Showbiz acts solely as a technology intermediary between the User and Clients, without acquiring the status of employer, principal, employment agency or commercial agent with respect to the User. Any employment or collaboration relationships that may arise between the User and Clients remain the sole responsibility of the parties involved.
3. Registration Requirements
To register on the Platform, the User must:
- be at least 18 years of age;
- provide truthful, accurate and up-to-date personal data;
- have an active WhatsApp phone number under their exclusive control, which is required for identity verification and ongoing Platform access;
- have a valid and functioning email address;
- be resident or domiciled in a country where the Platform’s services are available and legally accessible.
Registration by persons under 18 years of age is expressly prohibited. Showbiz reserves the right to request identity documents for age verification and to immediately delete profiles found to belong to minors.
4. Registration and Formation of Agreement
The Agreement is concluded when the User:
- completes the guided registration process via the WhatsApp channel or the Platform’s web form;
- provides the required data and uploads photographs of their profile;
- expressly accepts these Terms and the Privacy Policy by ticking the mandatory checkbox.
The User receives confirmation of completed registration via WhatsApp and/or email. This confirmation constitutes acceptance by Showbiz of the Agreement.
In accordance with Legislative Decree 70/2003 (implementing EU Directive 2000/31/EC on e-commerce), Showbiz makes these Terms available to the User in printable and storable form before the Agreement is concluded.
5. Free Service
Creating and maintaining a profile on the Platform is completely free of charge for the User. Showbiz does not charge:
- registration or subscription fees;
- fees for profile visibility;
- commissions on applications or casting selections;
- payments for access to published opportunities.
If optional paid services are introduced in the future, Users will be informed in advance and will have the option to decline without any consequences for their free profile.
6. User Obligations
The User undertakes to:
- provide only truthful data, photographs and information relating to themselves personally;
- not upload content belonging to third parties without their express written consent;
- not upload illegal, obscene, defamatory, discriminatory or third-party intellectual property-infringing content;
- keep profile information up to date, notifying Showbiz of any relevant changes;
- not use the Platform for autonomous advertising, commercial purposes or spam;
- not attempt to gain unauthorised access to the Platform’s computer systems or other Users’ profiles (Article 615-ter of the Italian Criminal Code);
- not assign, lend or share their access credentials — including the registered WhatsApp phone number — with third parties, nor in any way enable unauthorised persons to access their profile;
- not create multiple accounts for the same identity;
- keep their mobile device, SIM card and associated WhatsApp account under strict and careful custody, in the knowledge that anyone with physical or logical access to that device or account — even temporarily or as a result of theft, loss, SIM swap, physical access or voluntary or involuntary sharing — is capable of operating on the Platform with the same powers as the account holder, including accessing sensitive personal data;
- take all reasonably available security measures (device PIN, screen lock, two-factor authentication on the WhatsApp account, SIM PIN protection) to prevent unauthorised access;
- notify Showbiz immediately — by email to [email protected] — in the event of loss, theft or compromise of the mobile device, SIM card or WhatsApp account registered with the Platform, or upon becoming aware of any suspicious or unauthorised access to their profile, so that timely account suspension can be carried out;
- notify Showbiz of any change to the registered WhatsApp phone number before that change takes effect, so that access credentials can be updated.
Breach of one or more of the obligations in this Article entitles Showbiz to immediately suspend or permanently delete the account, without prejudice to Showbiz’s right to claim compensation for any resulting damage.
7. Account Security and Liability for WhatsApp Access
7.1 WhatsApp number as sole access credential
The Platform uses the WhatsApp phone number registered by the User as the sole authentication method. This number provides access to the User’s profile and enables viewing and editing of personal data, reviewing casting applications, receiving work proposals, and performing any operation available on the Platform.
The User expressly understands and agrees that anyone with access to their mobile device, SIM card or WhatsApp account — including temporarily or as a result of theft, loss, SIM swap, physical device access, or voluntary or involuntary sharing — is able to operate on the Platform with the same powers as the account holder, including the ability to:
- view all personal data, photographs and videos in the profile;
- modify profile data, photographs and information;
- submit or withdraw casting applications;
- communicate with Platform Clients on behalf of the User;
- request deletion of the account.
7.2 Exclusion of Showbiz liability for third-party access
Showbiz has no technical means of distinguishing between access by the registered account holder and access by a third party using the same WhatsApp phone number. Accordingly, Showbiz is in no way liable for:
- unauthorised access to the User’s profile by third parties via the registered WhatsApp phone number;
- any operation performed on the Platform by third parties who have gained access, in any way and for any reason, to the User’s mobile device or WhatsApp account;
- disclosure, modification or use of the User’s personal data by third parties as a result of such unauthorised access;
- damage of any nature — financial, non-financial, reputational — suffered by the User as a result of unauthorised Platform access via WhatsApp, regardless of the cause (theft, device loss, SIM swap, cyber-attacks on third parties, incautious sharing of credentials).
This exclusion of liability applies even where the unauthorised access was not promptly reported to Showbiz pursuant to Article 6(k), with the consequence that it was not possible to suspend the account in time. Failure to notify, or late notification, by the User constitutes a sole cause that fully releases Showbiz from liability for all consequences of the unauthorised access.
7.3 Account suspension procedure
Upon receiving notification from the User pursuant to Article 6(k), Showbiz undertakes to suspend profile access as quickly as technically possible, generally within 24 working hours of receiving the notification. Showbiz is not liable for access that occurred prior to the actual suspension, nor for the period between the event that enabled unauthorised access and the User’s notification.
7.4 Liability for operations performed via WhatsApp
All operations performed on the Platform via the registered WhatsApp phone number are presumed to have been carried out by the registered account holder. The User is solely and exclusively responsible for all operations performed via their WhatsApp number, including those carried out by third parties with or without their consent, until Showbiz receives formal notification of account compromise and suspends the account. Showbiz cannot retroactively undo operations performed before suspension.
8. Uploaded Content — Rights and Licence
8.1 Ownership
The User retains full ownership of the image rights and intellectual property rights over the photographs, videos and other original content they upload to the Platform. By uploading content, the User declares and warrants that they are the legitimate owner of the rights to such content or hold valid authorisation for its publication, and agrees to hold Showbiz harmless from any third-party claims in this regard.
8.2 Licence granted to Showbiz
By uploading content, the User grants Showbiz a non-exclusive, royalty-free, revocable licence, limited to the subject matter of this Agreement, to:
- store and display the content on the Platform;
- make it accessible to Platform Clients in the context of searching for profiles for castings and selections;
- process it technically for display optimisation purposes only (resizing, format optimisation, thumbnail generation);
- use it in internal intermediation communications with Clients.
8.3 Licence limitations
Showbiz does not sell, assign or transfer the User’s content to third parties outside the Platform’s intermediation activity, does not use the User’s images in its own advertising campaigns without separate explicit consent, and does not sub-licence content to parties other than Clients operating through the Platform.
8.4 Revocation of licence
The licence may be revoked at any time by deleting the account. Upon deletion, Showbiz will remove the content within 30 days, subject to any retention obligations imposed by law or authority.
9. Services Offered by the Platform
Through the Platform, the User may:
- create and manage their professional profile with data, photographs and videos;
- set profile visibility and privacy preferences;
- receive casting proposals compatible with their profile via WhatsApp;
- apply for castings of interest;
- receive communications from Clients through Platform channels;
- interact with the Platform’s automated assistant to update their profile and manage applications.
Showbiz reserves the right to modify, suspend or discontinue individual services with reasonable notice, except in cases of urgency related to Platform security.
10. Showbiz Liability and Limitations
10.1 Showbiz commitments
Showbiz undertakes to:
- maintain the Platform in operation with reasonable continuity;
- adopt appropriate technical and organisational security measures to protect User data on its systems (Article 32 GDPR);
- process personal data in compliance with EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003 as amended.
10.2 Exclusions of warranty
Showbiz does not guarantee:
- the number, frequency or quality of available casting opportunities;
- the identity, reliability or solvency of Platform Clients;
- the positive outcome of applications or selections;
- uninterrupted availability of the service;
- that use of the Platform will result in employment relationships, assignments or remuneration of any kind.
10.3 Exclusion of liability for unauthorised access
In addition to and without limiting what is set out in Article 7, Showbiz is not liable for any damage, loss, breach of confidentiality or consequence of any nature arising from:
- unauthorised access to the User’s profile via the User’s WhatsApp phone number, mobile device or WhatsApp account by third parties;
- voluntary or involuntary sharing by the User of their access credentials or device;
- compromise of the User’s mobile device or WhatsApp account by causes external to Showbiz’s systems (theft, loss, SIM swap, malware, phishing attacks, physical device access by third parties);
- failure or delay in notifying Showbiz of account compromise pursuant to Article 6(k).
10.4 Exclusion of liability for third-party content and Client relations
Showbiz is not liable for:
- content uploaded by Users and any resulting violations of third-party rights;
- the conduct, statements or omissions of Platform Clients towards Users;
- agreements, contracts or employment relationships established directly between Users and Clients outside of or via the Platform;
- failure by Clients to pay Users for services agreed independently of Showbiz.
10.5 General limitation of liability
To the fullest extent permitted by applicable law, Showbiz is not liable for indirect, consequential, incidental damages, loss of profit, loss of opportunity, reputational damage or non-financial damage of any kind arising from the use or inability to use the Platform, except in cases of Showbiz’s own wilful misconduct or gross negligence directly demonstrated by the User.
Showbiz’s total aggregate liability to the User in connection with the free Platform services shall in no event exceed — save for wilful misconduct or gross negligence — the symbolic amount of €100.00, which the parties acknowledge as fair compensation given the free nature of the service.
11. Account Suspension and Deletion
11.1 Voluntary deletion
The User may delete their account at any time by:
- sending a request to [email protected];
- using the function available on their profile page on the Platform.
Deletion results in the removal of personal data in accordance with the Privacy Policy, subject to any statutory retention obligations.
11.2 Suspension or deletion by Showbiz
Showbiz reserves the right to suspend or delete a User’s account in the event of:
- breach of these Terms or the Privacy Policy;
- provision of false or misleading data or forged documents;
- use of the Platform for unlawful or fraudulent purposes;
- conduct that causes harm to the Platform, other Users or third parties;
- account compromise notification by the User pursuant to Article 6(k);
- prolonged profile inactivity exceeding 24 months (with 30 days’ email notice).
Where suspension is due to a breach, Showbiz will notify the User at the registered email address, unless notification would be prejudicial to Platform security or ongoing investigations. Showbiz is not liable for any damage resulting from account suspension or deletion carried out in accordance with these Terms.
12. Personal Data Processing
The processing of the User’s personal data is governed by the Privacy Policy available on the Site, compliant with EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003 as amended.
By accepting these Terms, the User declares that they have read the Privacy Policy and are aware of the purposes, legal bases and retention periods for processing their data. The User acknowledges that their sensitive data (photographs, physical measurements, contact information) are accessible via the registered WhatsApp channel, and that the security of that channel is their sole responsibility as specified in Article 7.
The User’s rights as a data subject (access, rectification, erasure, restriction, portability, objection) may be exercised by contacting the Data Controller at [email protected].
13. Intellectual Property of the Platform
The website showbizinc.it, its design, logos, trademarks, texts and content owned by Showbiz are protected by intellectual property law (Italian Law 633/1941 and Legislative Decree 30/2005). The User is not authorised to reproduce, distribute, modify or commercially exploit them without the prior written consent of the Owner. The User may share links to their public Platform profile for professional self-presentation purposes.
14. Amendments to Terms
Showbiz reserves the right to amend these Terms at any time, to reflect regulatory changes, new Platform features or operational changes.
Amendments will be communicated to the User by email with at least 15 days’ advance notice before taking effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms. If the User disagrees, they have the right to delete their account before the effective date, free of charge and without penalty.
15. Governing Law and Jurisdiction
These Terms are governed by Italian law. For any dispute arising from the interpretation, performance or termination of this Agreement, the parties submit to the exclusive jurisdiction of the Court of Bologna, subject to any mandatory consumer forum provisions under Article 66-bis of Legislative Decree 206/2005, where applicable.
Pursuant to Article 14 of EU Regulation 524/2013, users are informed that the European Commission has established an online dispute resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr.
16. Severability
The invalidity, ineffectiveness or unenforceability of any single provision of these Terms shall not affect the validity and effectiveness of the remaining provisions, which shall remain fully valid and enforceable.
